WHAT COOKIES ARE

Cookies are small text files that websites send to a user’s browser (Microsoft Edge, Mozilla Firefox, Google Chrome, etc.), where they are stored and later retrieved when the same user visits the site.

Cookies serve various purposes, such as performing computer authentication, session tracking, and storing information on specific configurations related to users accessing a server. They can also be used to store preferences or facilitate access to online content, such as keeping track of items in a shopping cart or auto-filling a form.

Some cookies, however, are used for profiling users, meaning they track user behaviour to:

  • Send targeted advertising
  • Measure advertisement effectiveness
  • Adopt marketing strategies

In this case, such cookies are referred to as profiling cookies. Similar tracking outcomes can also be achieved through other tools and techniques, including fingerprinting.

While browsing a website, users may also receive third-party cookies, meaning cookies from different websites or web servers. This occurs when a website contains external elements such as:

Images, maps, sounds, or social buttons (e.g., the Facebook “Like” button)

Links to external web pages residing on servers other than the one hosting the visited page.

In other words, third-party cookies originate from a different domain that the website the user is currently visiting.

Technical cookies are those used exclusively for the purpose of transmitting communication over an electronic network or providing a service explicitly requested by the user (Article 122, paragraph 1, of the Privacy Code – Legislative Decree 196/03, as last amended by Legislative Decree 101/18).

These cookies enhance the browsing experience or enable services requested by the user. They are not used for any other purposes and are usually installed directly by the website owner.

Without these cookies, certain operations would difficult or impossible, such as performing home banking activities (e.g., viewing account statements, making transfers, or paying bills). These cookies are essential for allowing users to remain authenticated within a session.

For this reason, technical cookies cannot be disabled, and user consent is not required for their installation (pursuant to Article 122 of the Privacy Code), as they are considered strictly necessary for storing information essential to providing a requested service.

Analytical cookies, also known as statistical cookies, may be first-party or third-party cookies. They are installed to collect information about website usage and monitor user activity.

The Italian Data Protection Authority has clarified that these cookies can be considered equivalent to technical cookies if they are used for site optimisation by the website owner, who may collect statistical data in an aggregated about

  • The number of visitors
  • How visitors interact with the website

(See provision of 8 May 2014 and Guidelines on cookies and other tracking tools of 10 June 2021).

If statistical analysis is performed by third parties, then user data must be minimised beforehand and must not be combined with other data processing or shared with additional third parties. Under these conditions, analytics cookies are subject to the same rules as technical cookies regarding user information and consent.

Profiling cookies, on the other hand, are used to create user profiles and send advertising messages tailored to user preferences. According to Article 122 of the Privacy Code, the storage of or access to information on a user’s device is only permitted with the user’s prior consent, following the simplified information process described in Article 13, paragraph 3.

WHICH COOKIES ARE USED

The Site exclusively uses technical cookies, which are necessary for its proper functioning and to provide the services requested by users. As such, prior consent does not need to be obtained from users for their use.
